Please read these Terms of Service carefully before using our website, operated by Calycom Limited. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

  • By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Terms of Service

1. User Agreement:

By using our services, all customers agree to adhere to our Terms of Service (TOS). The TOS aims to ensure respectful use of our services, considering other internet users and the integrity of our network. Although we have tried to be comprehensive, the TOS isn't exhaustive. We reserve the right to update or amend the TOS without prior notice. Any changes become effective once posted and override any previous agreements or understandings, whether written, spoken, or implied.



2. Violating our Acceptable Use Policy:

Any breach of our Acceptable Use Policy or the Terms of Service can result in the suspension of your account and/or servers without notice.



3. Accounts:

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. Notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.



4. Links To Other Web Sites:

Our Service may contain links to third-party websites or services not owned or controlled by Calycom Limited. Calycom Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You further acknowledge and agree that Calycom Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.





5. Termination (Service Abuse):

By using our Services, you agree to not abuse systems or networks in any way that may harm the usability of other client services or harm outside networks or individuals.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breaches of the Terms.

Example reasons can be:

• harming outside networks (outgoing (d)DoS attack)
• harming other users (hosting or distributing malicious files or malware e.g. "mirai")
• abnormal high network usage (over 200 Mbit/s download/upload or high pps (packets per second) for an extended period of time (few days)
• abnormal high CPU usage (over 90%) for an extended period of time (few days)
• hosting illegal content (Child porn, Weapon stores, Terrorism or promoting hate speech in any form)
• hosting fraud or phishing content
• outgoing E-mail spam or anything that will upset Spamhaus
• unsolicited e-mail spam harming other users on the host system or the host system itself

After expiration of a Service, your right to use the Service will immediately cease. If you wish to terminate your Service, you may simply stop paying the Service.

We are not responsible for reminding you to extend your Service or to pay invoices. You must pay invoices within 3 days to avoid deletion of that invoice.



6. Data Responsibility:

You are responsible for the data on your service. We are not responsible for any data loss that may occur during rare incidents such as hardware failures, but we will attempt to restore data from our automated backups if hardware failures occur. You are responsible for the actions that occur on your service.



7. Support:

All support requests must be submitted through our ticket system (or Telegram) in our customer center. We are not required to provide support via live chat, email, Discord, forums, or other contact methods. We provide self-managed services, which means that the client is responsible for installing, configuring, and managing their services.



8. SMTP Ports:

Ports 25, 465, and 587 are closed and cannot be opened to prevent our IP subnets from being ruined by low-quality spammers. If you've purchased a server from us with the intention of engaging in spamming activities and want a refund, we regret to inform you that we cannot help you with that. Our services cater to Dedicated Server, VPS, VDS, & RDP hosting, not email/marketing services.



9. Changes:

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

1. What Information Do We Collect?

We take privacy very seriously and will make no compromise to defend it. We collect minimal information from our clients when they place an order and become our customers. This information may include:

• Name
• E-mail Address
• Billing details (including IP address used for login)

We do not collect or store any credit card details on our website.

All data may be deleted upon user's termination request as defined by the EU's landmark GDPR legislation.



2. What other information are we entrusted with?

As an hosting service provider, we are technically entrusted with your company's important data, including but not limited to:

• Databases
• Electronic email
• Server content files
• Any other information automatically collected by our products or website



Our Service may contain links to third-party websites or services that are not owned or controlled by Calycom Limited, such as:

• DDoS-Guard (DDoS Protection)
• Telegram (messages application for support)
• Cryptomus (Cryptocurrency gateway for accepting crypto payments)
• Virtualizor (Web-based VPS Management Control Panel)
• Whmcs (Client Management, Billing & Support Solution)



3. What Do We Use Your Information For?

The information we collect when you place an order and become a customer may be used in the normal operations of our service, such as contacting you regarding technical, network, billing, or abuse issues. The entrusted information regarding your service will never be used except in rare cases of investigating abuse issues.



4. Do We Disclose Any Information to Outside Legal Parties?

We will not disclose any information we collect or that is entrusted to us to any attorneys, law firms, courts, or law enforcement agencies unless presented with an official court order executed by a judge or magistrate within the Dutch court in Hague (Netherlands).



5. Changes to This Privacy Policy

We reserve the right to modify this policy at any time. We will notify you of any changes by posting the new Privacy Policy on this page.


Refund Policy

1. Payments

All payments are final and non-refundable. However refunds may be granted after the activation of your Service with a good reason. Each refund request is evaluated on a case-by-case basis. It is important to note that any violation of our Terms of Service (TOS) renders you ineligible for a refund. Refunds are only available in Bitcoin and Monero.
